Terms of service

1. Agreement and contracting party

These Terms govern purchases from and use of March Analytics, a customer-facing brand operated by Lavagoat wholesale LLC. By placing an order, submitting a sample, accessing a report, or otherwise using the service, the customer agrees to these Terms and the policies incorporated by reference.

March Analytics will use an affirmative acceptance mechanism associated with the order and will retain the applicable policy version and acceptance record with the transaction where technically available.

2. Eligibility and authority

March Analytics currently offers its services only in the United States. Customers must have legal capacity and authority to purchase testing services and to submit the sample. Customers must be at least 18 years old and have legal capacity to enter into a binding agreement. A person ordering for an organization represents that the person is authorized to bind that organization.

3. Nature of the service

March Analytics sells analytical testing services. It does not sell or ship peptides, research compounds, pharmaceutical products, supplements, or other customer-bound physical merchandise. The customer supplies the material to be tested.

Testing is for analytical and research purposes. Results are not medical advice, do not provide dosage guidance, do not authorize human or animal use, and do not determine that any material is safe, effective, lawful, sterile, suitable, or fit for a particular use unless a specific purchased test and report expressly establish a defined analytical characteristic.

4. Orders, payment, and taxes

An order is a request for the testing service described on the applicable product/service page. March Analytics may reject, suspend, or cancel an order when the sample is ineligible, the requested service cannot lawfully or safely be performed, the order appears fraudulent, or the laboratory cannot perform the requested analysis.

Payments are processed through the payment methods made available through Shopify and its payment-service providers. March Analytics may review duplicate or suspicious transactions and will apply taxes when required by the store configuration and applicable law.

5. Sample ownership, lawful submission, and acceptance

The customer retains responsibility for lawful possession, description, packaging, shipment, and submission of the sample. Submission does not transfer ownership of any unconsumed material except to the extent reasonably consumed, retained, or disposed of under the applicable Sample Handling, Storage and Disposal Policy.

March Analytics may refuse or stop work on any sample that is unsafe, unknown, improperly packaged, materially different from its description, prohibited by policy, or requires a license/registration/handling capability that has not been confirmed. The Customer Sample Attestation and Acceptable and Prohibited Samples Policy are incorporated into these Terms.

6. Shipment to the laboratory

The customer, not March Analytics, ships the customer-owned sample to the approved receiving location at 4030 W 1st Ave, Suite 100, Eugene, OR 97402, United States. Customers must follow the current Sample Submission and Shipping Policy and any test-specific receiving instructions before shipment.

Carrier transit, packaging, lost shipments, damage, and receipt are governed by the Sample Submission and Shipping Policy. March Analytics does not provide outbound fulfillment of tested compounds or customer merchandise.

7. Laboratory performance and subcontracting

March Analytics may perform or coordinate testing through one or more laboratory partners. Where appropriate to the service and report format, the performing laboratory may be identified on the analytical report. If a laboratory partner is used, March Analytics may provide that laboratory with the sample and the minimum order/sample information necessary to perform and document the service, subject to the Privacy Policy and applicable contractual safeguards.

8. Turnaround and delays

Any quoted turnaround is an estimate stated in business days and is measured from the operational milestone expressly identified on the Turnaround page, not automatically from payment, shipment, or carrier delivery. The turnaround clock begins after the sample has been received, accepted, and accessioned for testing. Any service-specific turnaround estimate is stated on the applicable Shopify product page or order materials. Rush or expedited service applies only when expressly offered for that service.

Delays can result from sample nonconformity, carrier events, method/QC issues, equipment or laboratory capacity, customer response time, or events outside reasonable control. Remedies for laboratory-caused delay must match the Refund and Cancellation Policy.

9. Results and scope of the COA

A Certificate of Analysis or analytical report applies only to the specific sample actually received, prepared, and tested. It must not be generalized to another vial, lot, batch, product, seller, manufacturer, or untested material. A result is not an endorsement of a seller, manufacturer, brand, product line, or intended use.

Results are private customer information. March Analytics does not publish customer COAs or operate a public COA database. A customer may share a complete, unaltered copy of the customer’s report for lawful purposes. The report may not be edited, excerpted, relabeled, or presented in a way that implies testing of different material or endorsement by March Analytics.

10. Analytical limitations, corrections, and retesting

All analytical methods have limits. The meaning of a result depends on the sample, preparation, method, reference materials, calibration, uncertainty, detection/quantification limits, and report scope. The Laboratory Limitations and COA Use Policy is incorporated into these Terms.

Retests and corrected reports will be separately identified. A corrected or amended report will preserve a stable report identifier and revision status so that superseded versions are distinguishable from the current report.

11. Refunds and cancellations

Refunds and cancellations are governed by the Refund and Cancellation Policy. Eligibility may change as the service progresses from order placement to sample receipt, accession, analysis, and report preparation. Refund eligibility follows the Refund and Cancellation Policy and becomes more limited as laboratory work is consumed. Once analytical work begins, the service is generally non-refundable except for verified laboratory error or inability to perform the purchased service.

12. Customer conduct and prohibited uses

  • Do not submit a sample you do not lawfully possess or have authority to submit.

  • Do not conceal or misstate a sample’s identity, hazards, regulatory status, composition, or intended analytical purpose.

  • Do not use a COA to represent an untested sample, different batch, seller inventory, or product line.

  • Do not alter a report in a manner that creates a false, incomplete, or misleading analytical representation.

  • Do not use the service or report to make medical, therapeutic, dosage, or human/animal-use claims that the report does not establish.

  • Do not interfere with the website, accounts, report-delivery systems, or laboratory operations, or attempt unauthorized access.

13. Intellectual property and report use

The website, text, design, trademarks, and standard report format are owned by or licensed to Lavagoat wholesale LLC, subject to applicable rights of third parties. The customer owns the customer-provided information and retains rights in the customer-owned sample. March Analytics grants the customer a limited, nonexclusive right to use and reproduce the customer’s complete, unaltered report for lawful purposes. March Analytics names, logos, and report design may not be used to imply sponsorship, certification, or testing of material not covered by the report.

14. Privacy and electronic communications

Use of the service is subject to the Privacy Policy. Customers consent to receiving electronic service communications reasonably necessary to complete an order, including payment, sample, support, and private-result messages. Transactional service communications are distinct from optional marketing communications. Marketing communications, if used, are separate from transactional service communications and are sent only in accordance with the customer’s applicable consent and opt-out choices.

15. Compliance, sanctions, and legal process

Customers must comply with applicable laws relating to possession, shipment, export/import, hazardous materials, controlled substances, sanctions, and use of analytical results. March Analytics may refuse service or information disclosure when required by law and may preserve or disclose information in response to valid legal process as described in the Privacy Policy.

March Analytics serves the United States market and may refuse or cancel a transaction that it reasonably believes would violate applicable sanctions, trade restrictions, or other law.

16. Disclaimers, liability, and indemnity

To the extent permitted by law, the service is provided for the analytical scope stated in the order and report, subject to inherent analytical limitations. March Analytics does not warrant outcomes beyond the expressly reported test result.

To the maximum extent permitted by law, March Analytics is not liable for indirect, incidental, special, exemplary, or consequential damages arising from the service. March Analytics’ aggregate liability for a claim relating to a specific order will not exceed the amount paid for the affected service. Nothing in these Terms limits rights or remedies that cannot lawfully be limited. The customer is responsible for losses arising from unlawful sample possession or submission, material misrepresentation of a sample, or misuse or falsification of a report.

17. Disputes and governing law

Customers should first contact [email protected] for service issues and [email protected] for billing/refund disputes. Formal legal notices should be sent to [email protected] and to the legal entity at the business address shown below.

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Subject to any nonwaivable consumer rights, disputes will be brought in the state or federal courts located in or serving Lane County, Oregon. This draft does not require mandatory arbitration or a class-action waiver. Disputes are subject to the governing-law and venue provision above unless the parties later agree otherwise in writing.

18. Changes and severability

March Analytics may update these Terms prospectively. The version applicable to an order should be the version accepted when the order was placed, subject to changes required by law. March Analytics may update these Terms prospectively and will post the current version on the storefront. Material changes will apply to future transactions unless applicable law requires otherwise; the version accepted for an order remains associated with that order. If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law.
